
On Wednesday, November 3, the Indiana State Police District 13 Criminal Investigations Division was contacted by the Porter County Sheriff’s Department to investigate an officer involved shooting that occurred at 138 S. 450 W. in rural Porter County. At approximately 2:00 p.m., Porter County Police arrived at the residence to serve a warrant to James W. Filby, 58, from Valparaiso, IN. During the officer’s initial encounter with Mr. Filby, the suspect met the officers outside the residence and produced a handgun. Shots were fired by both Mr. Filby and an officer. Mr. Filby sustained injuries that required him to be flown to Chicago by UCAN. His current injury status is not known.
The warrant to be served was for the following offenses:
- Child Molesting- Class C Felony
- Vicarious Sexual Gratification- Class D Felony
- Attempted Sexual Battery- Class D Felony
- Attempted Sexual Battery- Level 6 Felony
- Sexual Battery- Level 6 Felony
This is an ongoing investigation. Questions as to the identity of the officer as well as the duty status of that officer should be directed to the Porter County Sheriff’s Department.
All suspects are considered innocent until proven guilty in court.
